Constitutional procedures to reinstate 2009 Kuwaiti parliament

All legal procedures are going on smoothly to implement the Constitutional Court’s verdict to dissolve the 2012 Parliament and reinstate the former parliament speaker Jassem Al-Khorafi yesterday.

In press statements, Al-Khorafi expressed hope that the procedures would be completed properly to avoid any mistake that can be used in any future legal action against 2009 parliament.

Kharafi noted that the 2009 parliament would convene following the formation of the new government which would take oath before the legislators. He stressed that the Constitutional Court verdict has to be respected regardless of the possibility that the 2009 parliament may be dissolved again.

“I will call for the parliament to convene, but if it has failed to reach quorum in the first session, I will call for a second one. In case of failure, I will refer the issue to His Highness the Amir Sheikh Sabah Al-Ahmad Al-Jaber Al-Sabah to take the proper decision,” he said.

He laid it bare that HH the Amir has the sole power to dissolve or reinstate the 2009 parliament. On June 20, the Kuwait Constitutional Court annulled the legislative elections held on February 2, 2012 and canceled the membership of MPs who were declared winners.

The court based its decision on the grounds that the two decrees, issued by HH the Amir to dissolve the previous Parliament, and calling for fresh elections were illegal. The Kuwaiti parliament was dissolved four times since 2006, but this the first time in Kuwaiti history that a parliament was dissolved by a Constitutional Court verdict.
